Trademark Clearinghouse (TMCH) Claims Process Setup

ICANN requires Registrars to notify applicants, in the first 90 days after the Sunrise Period for any new gTLD, if the name they're trying to register has a pre-existing Claim in the Trademark Clearinghouse. A Registrar must obtain the relevant claim information from the Registry and the TMCH and display a notice to the applicant, real-time, upon check availability.

Note

This requirement is limited to the new gTLD domain names only. No ccTLDs or other extensions being launched are affected by this.

Implemenation

  1. Registrars need to obtain their TMDB credentials from ICANN/TMCH, and these credentials will be used to check the Claim status. Certain tests must be performed to obtain TMDB certification before the Registrar's credentials can be used.

  2. During the check availability of a domain name in the claims period, if the name matches a label registered in the Trademark Clearinghouse, the Registry will provide a lookup key to the Trademark Clearinghouse database. The system will obtain the lookup key and return it as a Token.

    • On the Supersite, existence of a Trademark Claim will be indicated while adding the domain name to the shopping cart.

    • API users will receive the Claim status and Token as additional response parameters with the domain name check availability call.

  3. Display of Claim Notice:

    • While adding the domain name to the shopping cart, the SuperSite will display a Claim Notice with the Trademark Claim as obtained from the Trademark Clearinghouse database.

    • API users will pass a separate call to obtain the Claim Data.

  4. The Claim Notice will explain to the applicant the significance of the Claim, and will require the applicant to agree that his / her / their registration of the domain name does not infringe on the Trademark rights listed in the notice.

  5. If the applicant does continue with the registration, appropriate confirmation needs to be sent to the Registry.

    • The SuperSite will handle sending of the confirmation to the Registry.

    • API users will pass this extra information through the Domain Name Register API call.

New gTLD Wishlist

Beginning early 2014, a whole new range of new Top-Level Domain (TLD) extensions will be launched, with hundreds of extensions coming your way. The Internet now offers targeted extensions in a variety of categories such as Sports, Technology, Services or Hobbies. Now you can get a domain name that better desribes you and your business.

The exact launch timeline for each New gTLD is still uncertain. Hence, it is recommended that you create a New gTLD Wishlist with at this stage. will keep track of the launch plan for every New gTLD, and notify you via email when pre-registrations for the chosen TLDs start.

Create and Maintain a Wishlist Though SuperSite 2

Creating a Wishlist

  1. Login to your Control Panel. See details

  2. Click the button in the top right corner of the page.

  3. Click the Go to Supersite » link in the top right corner of the page.

  4. In the Menu, point to Domains and then click New Domain Extensions.

  5. Mention the string or name of your choice in the search field and then click the Search button.

  6. The next page will display your string with a list of TLDs for the chosen category.

  7. Click the Notify Me button adjacent to the domain name of your choice. You can select multiple domain names here.

    The selected domain names will now appear in the Notify me by email section.

  8. Click the Continue button.

  9. Specify the Customer Username and then click the Place your order button.

  10. Click the Confirm Order button to add the domain names to your Wishlist.

Managing a Wishlist

  1. Login to your Control Panel. See details

  2. Next, click

    For Resellers: Products -> Domain Registration -> New gTLD Wish-lists.

    For Customers: Manage Orders -> New gTLD Wish-list.

  3. This wiil list all the domain names in your Wishlist. You may further tweak these results by submitting one or more of the following parameters:

    • For Resellers: Belonging to: You can filter the list based on a domain name or a Customer or a Sub-Reseller. Choose the appropriate option from the drop-down menu and mention either the domain name or the Customer ID or the Sub-Reseller ID.

      For Customers: Domain Names: You can search for a specific domain name.

    • TLD: Mention the TLDs here.

    • Added between: Select the Start Date and End Date to search within a specific date range.

    • Include Sub-Reseller's results: You can include Wishlist details belonging to your Sub-Resellers, by selecting this check box.

  4. If required, you may delete a domain name from the Wishlist by selecting the checkbox adjacent to it and clicking the Delete button.

Sunrise Period

When new Top-Level Domain (TLD) extensions are being launched, they typically begin with a 30 to 60 day period called Sunrise Period. During the Sunrise Period, Domain Names can not be registered by the general public, but only by those who hold a Trademark for a particular string or term. This allows Trademark holders to secure the domain name that matches their Trademark, and prevents it from being registered for fraudulent or malicious purposes.

In the Sunrise Period, the Registration of a Domain Name requires the applicant to provide some proof of their Trademark matching the name being registered. The exact proof required depends on the Registry that operates that TLD. The allocation of Domain Names also depends on the Registry itself - a Domain Name may be allotted on first come, first serve basis, or at the end of the Sunrise period. In the latter case, if there are multiple applicants with a valid Trademark for a particular string, the Domain Name may be put up for a private auction where both applicants would bid for the right to register the Domain Name.

Note

Sunrise Registrations do not give the Registrant a perpetual claim over the Domain Name. The Registrant is expected to renew the Domain Name to maintain their Registration just like any other Domain Name failing which it would become available for anyone to register.

About the Trademark Clearinghouse (TMCH)

Starting October 2013, the Sunrise Period for any new Generic Top-Level Domain (gTLD) is expected to be served through a special Trademark Clearinghouse (TMCH) as mandated by ICANN, the governing body for Domain Names. A Trademark holder who wishes to register their Trademark name with any new gTLD is expected to first register their Trademark with the TMCH. When the TMCH reviews and validates their Trademark, the holder is allotted a Signed Mark Data (SMD) file that acknowledges their Trademark. This SMD file must be used by the holder as their proof while registering Domain Names in the Sunrise Period for any new gTLD that launches. The Trademark holder is not expected to supply any additional proof if they have a valid SMD file.

Note

The TMCH-faciliated Sunrise process is mandatory for Generic Top-Level Domain extensions. Country-code TLD extensions (ccTLDs) are not expected to rely on the TMCH for validating Sunrise Registration requests.

About the Signed Mark Data (SMD) File

The SMD file contains the below details:

  • Marks: The Trademark(s) that the SMD file refers to

  • smdID: A unique identifier for the SMD file

  • U-labels: The strings that the Trademark holder can use to register domain names in the Sunrise Period

  • notBefore: The start of validity of the SMD file

  • notAfter: The end of validity of the SMD file

  • Encoded SMD file: The actual SMD file is encoded between -----BEGIN ENCODED SMD----- and -----END ENCODED SMD-----. You should not modify your SMD file, as this may render the SMD file invalid.
